Shiboleth's diverse and international commercial litigation practice encompasses a team of lawyers adept at achieving the objectives of our clients. The litigation practice is directly aligned with the firm's capabilities in corporate law, technology, real estate, intellectual property, the Internet, employment, probate and bankruptcy law. Our attorneys regularly appear before the federal and state trial courts, at the trial and appellate levels, as well as in specialty courts, such as U.S. Bankruptcy Court. We offer our clients the following services.
Pre-Litigation Alternatives. Wherever possible, Shiboleth seeks to avoid the expense and inconvenience associated with litigation and explores the pre-litigation alternatives that may achieve our client's goals. These include pre-litigation settlement discussions, various activities and steps intended to demonstrate to one's adversary the weakness of the adversary's position and the client's resolve to move forward with litigation absent a resolution of the dispute, and mediation.
Civil Trial and Appellate Work. Shiboleth has extensive experience in all areas of civil trial work, including the drafting of pleadings, pre-trial discovery, motion practice, jury selection, presentation and cross examination of witnesses, and presentation of legal arguments. We also offer our clients extensive experience on the appellate level, both from the perspective of prosecuting and defending appeals. This includes formulation of arguments upon which to base appeal, preparation of appeal records and briefs, and oral argument of the appeal.
Alternative Dispute Resolution. Our attorneys regularly appear in both U.S. and foreign arbitration proceedings both prosecuting and defending arbitrations. Several attorneys have also served as arbitrators and mediators before the American Arbitration Association, international arbitration associations and by private agreement between parties in dispute.
Foreign Proceedings. Shiboleth routinely supervises, on behalf of its clients, the litigation activities of local counsel in cases being adjudicated outside of its geographic area and/or in multi-forum litigations. In that regard, we offer a high level of sophistication with respect to the judicial system in Canada, Israel and many European countries. We periodically handle enforcement of foreign awards and providing of US-based opinions to foreign jurisdictions and are routinely retained to handle cross-border probates. |
